A considerable number of Wills are contested each year. In 2025, 1,217 disputed probate cases were filed at the High Court, the highest on record. Many more are disputed informally and never reach court. These are the practical steps David talks through with families to reduce the risk.
Marriage, divorce, a new child, a death in the family, moving home or selling a business can all change what your Will should say. A Will that was right five years ago may no longer match your family, your property or the current rules.
David recommends treating estate planning as something you revisit whenever circumstances change, not as a one-off document that sits in a drawer.
Family fragmentation is one of the biggest causes of contentious estates. When relatives are asked to make decisions together under pressure, old tensions can resurface.
That is why David often advises clients to consider appointing a professional executor. It does not mean excluding your family; it means there is an independent person whose job is to make sure your wishes are followed and disputes are handled calmly.
Probate and Will registers are public documents. Charities routinely check them, and if they see they may be a beneficiary they will follow the case closely.
David's advice is to leave a fixed monetary amount, such as £1,000 to a named charity, rather than a percentage like 10% of your estate. Percentages create uncertainty for executors, who can then face commercial pressure and hostility they did not expect.
A Will is only one part of the picture. Letters of wishes, funeral instructions, guardian appointments and memorandums should all be checked regularly so they still reflect what you want.
